1. Introduction

These Terms and Conditions govern your use of the Agile Life Skills website and any services, products, programmes, workshops, coaching, consulting, memberships, events, digital resources, or content offered by Agile Life Skills.

By using this website, booking a service, purchasing a product, registering for an event, joining a membership, downloading a resource, or engaging with Agile Life Skills in any way, you agree to these Terms and Conditions.

If you do not agree, please do not use the website or services.

2. About Agile Life Skills

Agile Life Skills provides coaching, training, consulting, facilitation, workshops, memberships, digital products, and learning experiences in areas including AI confidence, Agile, leadership, change, productivity, business skills, personal development, and related topics.

Services may be delivered online, in person, live, pre-recorded, one-on-one, in groups, or through digital platforms including WhatsApp and email-based communities.

3. Use of the website

You agree to use this website lawfully and respectfully. You may not:

4. Information on the website

The information on this website is provided for general educational and informational purposes. While we aim to keep content accurate and up to date, we do not guarantee that all content is complete, current, error-free, or suitable for your specific circumstances.

Nothing on this website should be treated as legal, financial, medical, psychological, clinical, tax, or professional advice unless expressly stated in a signed agreement.

You are responsible for how you apply the information provided.

5. Coaching, training, and consulting services

Our services are designed to support learning, growth, confidence, strategy, implementation, productivity, leadership, and personal or organisational development.

Results depend on many factors including your participation, context, implementation, consistency, and external circumstances. We do not guarantee specific outcomes, including business results, income, promotions, performance improvements, or personal transformation.

6. AI-related services

Agile Life Skills provides training, coaching, workshops, resources, and guidance on the practical use of AI tools. You acknowledge that:

Agile Life Skills is not responsible for any loss, harm, compliance issue, reputational damage, or business impact resulting from your use of AI tools or AI-generated outputs, including in situations where AI training from Agile Life Skills informed that use.

7. Neurodiversity and learner support services

Agile Life Skills offers coaching, training, and support services related to neurodiversity, ADHD, learning differences, and educational support — including through The Learner Support Studio (TLSS) in collaboration with qualified specialists.

These services are educational and developmental in nature. They are not a substitute for medical, psychological, psychiatric, speech therapy, occupational therapy, or any other clinical assessment, diagnosis, or treatment.

Where services involve minors, participation requires the consent of a parent or legal guardian. Parents and guardians retain full responsibility for decisions made on behalf of their child based on coaching or training outputs.

If you or someone in your care is experiencing a crisis, is at risk of harm, or requires clinical support, please contact an appropriate healthcare professional or emergency service immediately.

8. Bookings and registrations

Bookings for coaching, workshops, programmes, events, memberships, or consulting services are subject to availability. A booking is only confirmed once the required payment, form, or written confirmation has been received.

We reserve the right to accept, decline, reschedule, or cancel bookings where necessary, including where minimum participant numbers are not met for a group programme.

9. Payments

Prices are displayed on the website, invoice, proposal, quotation, or payment page at the time of booking. All fees must be paid by the due date specified.

Where payments are processed through third-party payment providers (including CheckoutJoy), their own terms and privacy policies may also apply. You are responsible for ensuring that payment details are accurate and that you have authority to use the payment method provided.

Agile Life Skills reserves the right to withhold access to services, content, communities, or materials where payment is outstanding.

10. Refunds and cancellations

Unless otherwise stated in writing at the time of purchase:

If Agile Life Skills cancels a paid session, event, or programme and cannot provide a reasonable alternative, you may be offered a refund, credit, or rescheduled date.

11. Memberships and subscriptions

Agile Life Skills offers tiered membership options. By joining a membership you agree to pay the recurring fee applicable to your chosen tier at the time of joining. Tiers and pricing are subject to change with reasonable notice to existing members.

Access to membership content, communities, recordings, resources, and benefits may end when your membership is cancelled, unpaid, suspended, or terminated.

12. Online communities

Some services include access to WhatsApp groups or other online community spaces. You agree to participate respectfully and not post content that is abusive, discriminatory, unlawful, harmful, defamatory, confidential, misleading, or inappropriate.

We may remove content or restrict access to community spaces if behaviour is harmful, disruptive, or inconsistent with the purpose of the community.

Community spaces are not emergency support channels and must not be used for urgent, crisis, medical, psychological, legal, or safety-related matters.

13. Intellectual property

All website content, training material, frameworks, templates, recordings, slides, worksheets, videos, branding, programme structures, and resources are owned by or licensed to Agile Life Skills unless otherwise stated.

You may use purchased or downloaded materials for your own personal or internal business use only. You may not copy, share, reproduce, resell, publish, distribute, modify, upload, or commercially exploit our content without written permission. This applies even where material was provided during a free session, webinar, event, or community.

14. Recordings and event content

Some online sessions, workshops, webinars, and group programmes may be recorded. By attending a recorded session, you acknowledge that your name, voice, image, chat comments, or contributions may be captured. We will notify participants where a session is being recorded.

Recordings may be shared with registered participants, members, or clients, or used for educational or business purposes. We will take reasonable care not to disclose sensitive personal information unnecessarily.

15. User-submitted content

If you submit comments, testimonials, feedback, reviews, questions, or other content, you confirm that you have the right to share it. You grant Agile Life Skills permission to use feedback, testimonials, or non-confidential contributions for service improvement, educational, or promotional purposes, unless you specifically ask us not to.

We will not publish your identifiable testimonial, photograph, or personal story without permission.

16. Third-party tools and platforms

We use third-party tools including MailerLite, CheckoutJoy, Netlify, Zoom, and social media platforms to deliver our services. We are not responsible for the availability, security, terms, performance, or actions of third-party platforms. Your use of those platforms may be subject to their own terms and privacy policies.

17. Limitation of liability

To the fullest extent permitted by law, Agile Life Skills will not be liable for any direct, indirect, incidental, consequential, special, or financial loss arising from your use of the website, services, content, AI tools, resources, coaching, training, consulting, or third-party platforms. This includes loss of income, profits, data, opportunity, reputation, or expected results.

Our total liability for any claim will be limited to the amount you paid to Agile Life Skills for the specific service or product giving rise to the claim, unless the law requires otherwise.

18. Health and personal development disclaimer

Some Agile Life Skills services touch on personal development, productivity, confidence, neurodiversity, learning, emotional regulation, overwhelm, leadership, or workplace wellbeing. These services are educational and developmental in nature and are not a replacement for medical, psychological, psychiatric, therapeutic, legal, or clinical advice.

If you or someone else is in crisis, at risk of harm, or requires medical or psychological support, please contact an appropriate professional or emergency service immediately.

19. Corporate and organisational services

For corporate training, facilitation, consulting, AI adoption, Agile coaching, or organisational change services, the specific scope, deliverables, fees, timelines, cancellation terms, and responsibilities will be set out in a proposal, quote, statement of work, or written agreement. Where there is a conflict between these general Terms and a signed agreement, the signed agreement will apply to that engagement.

20. Dispute resolution

If a dispute arises in connection with these Terms or any service provided by Agile Life Skills, we ask that you first contact us directly at tash@agilelifeskills.com to attempt to resolve the matter informally. We will endeavour to respond within 5 business days.

If the matter cannot be resolved informally, the parties agree to attempt resolution through mediation before initiating formal legal proceedings, unless urgent legal relief is required.

This clause does not limit your statutory rights under South African consumer protection legislation.

21. Changes to services and pricing

We may update, change, suspend, or discontinue any service, product, programme, event, membership, offer, price, or website content at any time. Price changes will not affect confirmed bookings or purchases unless otherwise stated in the relevant agreement or payment terms.

22. Privacy

Your use of our website and services is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information in accordance with POPIA.

23. Breach of these Terms

If you breach these Terms, we may suspend or terminate your access to services, memberships, communities, resources, or website areas. We may also take appropriate legal or recovery action where necessary.

24. Governing law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute will be dealt with in South Africa, unless otherwise agreed in writing.
